ARTICLE 1 – PARTIES
This Distance Selling Agreement (“Agreement”) has been concluded between the SELLER and the BUYER , whose information is given below, in accordance with the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation, regarding the sale and delivery of the product ordered electronically by the BUYER through the www.nimmetal.com website (“Site”).

BUYER INFORMATION:
The name, surname, address, telephone and e-mail information declared by the BUYER during the order will be taken as basis.
ARTICLE 2 – SUBJECT OF THE CONTRACT
This contract regulates the rights and obligations of the parties regarding the sale and delivery of the product(s) whose qualities and sales prices are specified below, which the BUYER ordered electronically from the SELLER's website at www.nimmetal.com.
Product type, quantity, sales price and delivery information are specified on the summary page approved by the BUYER during order completion.
ARTICLE 3 – PRODUCT DELIVERY AND CONDITIONS
3.1. Products are manufactured to order. Average production time is 5 (five) business days .
3.2. Completed products are delivered to the BUYER within 10 (ten) business days , including shipping time.
3.3. Deliveries are made through cargo companies approved by the SELLER. The cargo company may vary depending on the order period.
3.4. Delivery is made to the address specified by the BUYER in the order form.
3.5. Domestic and international deliveries are available. Shipping times for international deliveries may vary depending on the logistics conditions of the relevant country.
ARTICLE 4 – PAYMENT TERMS
4.1. BUYER pays the product price via one of the payment methods offered on the Site.
4.2. The order will not be processed until payment is completed.
4.3. In case of cancellation of the order due to problems that may occur in the payment systems, the BUYER will be informed and the collected amount, if any, will be refunded within 14 days.
ARTICLE 5 – RIGHT OF WITHDRAWAL
5.1. The BUYER may exercise his/her right of withdrawal within 14 (fourteen) days from the date of receipt of the product, without giving any reason and without paying any penalty.
5.2. In order to exercise the right of withdrawal, the BUYER must notify the SELLER in writing within this period by sending an e-mail to info@nimmetal.com or via the contact form on the Site.
5.3. Following the notice of withdrawal, the return process and address information are shared with the BUYER.
5.4. For returns made within the scope of the right of withdrawal, the return shipping fee belongs to the SELLER.
5.5. The product must be returned to the BUYER in the same condition as it was delivered, complete and undamaged.
ARTICLE 6 – CASES WHERE THE RIGHT OF WITHDRAWAL CANNOT BE USED
The right of withdrawal cannot be exercised for the following products:
- Specially designed products produced in line with the BUYER's requests or personal needs.
- Products whose packaging, tape, seal or protective elements have been opened after delivery.
(Note: Nim Metal products are produced to order, but in standard sizes and forms; therefore, they are not considered as personalized production.)
ARTICLE 7 – RETURN PROCEDURE
7.1. When the BUYER wishes to return the product within the scope of the right of withdrawal, he/she contacts the SELLER.
7.2. SELLER informs BUYER about the necessary cargo direction and address information for the product to be returned.
7.3. After the returned product reaches the SELLER, the product price will be refunded within 14 days using the method used by the BUYER for payment.
ARTICLE 8 – GENERAL PROVISIONS
8.1. The BUYER declares that he/she has read, understood and accepted all the terms of the Agreement before confirming the order.
8.2. The order placed through the site comes into effect upon completion of the payment transaction.
8.3. The parties accept that Istanbul (Anatolian) Consumer Arbitration Committees and Consumer Courts have jurisdiction over any disputes that may arise from this agreement.
ARTICLE 9 – ENFORCEMENT
This Agreement shall enter into force upon approval electronically.
The BUYER is deemed to have accepted all the terms of this agreement when placing an order.
Effective Date: Valid as of the date of publication on www.nimmetal.com.
